The Company collects, receives, and maintains for business purposes the following types of Personal Information of current and former employees.
As well, to reduce the risk of spreading the COVID-19 virus in and through the workplace and protect our employees and members, the Company is implementing procedures for measuring the temperature of all employees coming into the Company’s facility and inquiring and observing whether any individual attempting to enter a Company facility has any symptoms of COVID-19 or related illness. Any individual, whether an employee, whose temperature is measured to indicate a fever, or any employee or member who reports having or is observed to have any such symptoms, or who has recently been in contact with symptomatic individuals will not be permitted to enter any Company facility.
1. Identifiers such as name, alias, postal or mailing address, email address, telephone number, SSN, driver’s license or state identification card number, passport number, or other similar identifiers;
2. Physical characteristics or description;
3. Medical and health information, specifically body temperature, and if certain symptoms are displayed such as fatigue, cough, sneezing, aches, pains, runny or stuffy nose, sore throat, diarrhea, headaches, or shortness of breath, whether one has recently been in close contact with anyone who has exhibited any of these symptoms, whether one has recently been in contact with anyone who has tested positive for COVID-19, and whether one has recently traveled to a restricted area that is under a Level 2, 3, or 4 Travel Advisory according to the U.S. State Department (including China, Italy, Iran, and most of Europe);
4. Insurance policy number, bank account number, credit card number, debit card number, or other financial account information;
5. Characteristics of protected classifications under California or federal law (e.g., race, ethnicity, sex, gender, sexual orientation, gender identity, religion, age, disability, military status, familial status, etc.);
6. Pre-hire documents, such as job application, resume, background check results, assessment results, job interview notes, reference checks and candidate evaluation records;
7. Professional or employment-related information, such as personnel files, new hire or onboarding records, emergency contact, I-9 forms and E-Verify system, tax forms, time and attendance records, non-medical leave of absence records, workplace injury and safety records, performance evaluations, disciplinary records, training records, licensing and certification records, compensation and health benefits records and payroll information and records;
8. Employee and covered dependents’ medical and health information, such as benefits enrollment records, doctor’s notes for absences or work restrictions, medical leave of absence records, requests for accommodation, interactive process records, and correspondence with employee and his/her medical or mental health provider(s) regarding any request for accommodation or medical leave of absence, as well as post-hire drug test results;
9. Biometric information, such as fingerprints;
10. Employee education-related information and records;
11. Visual, audio or video recordings of employees in the workplace, such as through surveillance cameras, or pictures or videos of employees taken in the workplace or at a Company function or event or for a Company promotion;
12. Information identifying which employees accessed secure Company facilities and at what times using their keys, badges, fobs or other security access method;
13. Geolocation data from Company-issued computers, electronic devices, and vehicles, as well as timekeeping applications on cell phones that employees use to clock in and out and that log the geographic location at which each time entry was made;
14. Internet, or other electronic network activity information on Company-issued computers and electronic devices, including browsing history, search history, and usage history; and
15. Data identifying employee cell phones that are granted access to Company networks and systems collected via the mobile device encryption platform that must be installed on employee mobile devices in order to be granted access to the Company network, including the cell phone make, model, and serial number, the cell phone number, and cell phone provider.
The Company collects, receives, and maintains the above categories of Personal Information for the following business purposes:
1. To comply with state and federal law and regulations requiring employers to maintain certain records (such as immigration compliance records, personnel files, wage and hour records, payroll records, accident or safety records, and tax records);
2. to comply with lawful subpoenas and discovery requests requiring disclosure of the employee’s information to a third party or government agency;
3. to reduce the risk of spreading the COVID-19 virus in and through the workplace and protecting our employees and member;
4. to effectively process payroll;
5. to maintain commercial insurance policies and coverages, including for workers’ compensation and other liability insurance;
6. to manage workers’ compensation claims;
7. to administer and maintain group health insurance benefits, 401K and/or retirement plans;
8. to manage employee performance of their job duties;
9. to conduct workplace investigations (such as investigations of workplace accidents or injuries, harassment, or other misconduct);
10. to evaluate job applicants and candidates for employment or promotions;
11. to obtain and verify background checks on job applicants and employees;
12. to comply with verification of employment and reference requests;
13. to grant employees access to secure Company facilities and maintain information on who accessed the facility;
14. to implement, monitor, and manage electronic security measures on employee devices that are used to access Company networks and systems;
15. to engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions of the Company;
16. to hold celebrations, give gifts or awards, create staff bios or news, or other celebratory actions or workforce highlights;
17. to post member fitness schedules;
18. to set up an employee membership agreement, create business cards, company contact lists and Intranet content, and other internal company required accounts; and
19. to book travel for the Company, such as car rentals, hotel stays, and flights.
