This agreement is made between INTERNATIONAL FIELD STUDIES, INC (“IFS”), 1550 Old Henderson Road, Suite E268, Columbus, Ohio, State of Ohio and (STUDENT NAME AS FILLED IN BELOW) hereinafter called “STUDENT.”
Witnesseth
WHEREAS IFS is engaged in the business of providing educational field studies; and
WHEREAS, STUDENT desires IFS to provide an educational field study;
NOW THEREFORE, it is agreed as follows:
1.0 STUDENT agrees he or she is solely responsible for the conduct of their actions and agrees to hold IFS harmless should any actions of the STUDENT be found to be in violation of any foreign, federal, state, or local law.
2.0 STUDENT agrees to not damage any facility, equipment, and/or property of IFS used, or made available for use.
3.0 STUDENT agrees to abide by all directions, rules, regulations, and requirements set forth by IFS and contracting schools, organizations, and clubs associated with this Field Study and in compliance with the IFS/Forfar code of conduct policy as follows:
- I understand that the legal drinking age in The Bahamas is 18 and any violation of this law will result in trip termination.
- If I drink as a legal adult, I will limit alcohol intake so I can conduct myself in a way that positively represents Forfar Field Station.
- I understand that there is a zero tolerance policy for all illegal drugs (illegal in The Bahamas) and alcohol on Forfar property.
- I will not smoke, vape, or chew tobacco in cabins, vehicles, or the lodge at any time nor will I do so on Forfar led excursions/trips.
- I will not purposefully damage any facility, equipment, or property of IFS/Forfar Field Station and if I do, I understand that I may be billed for any damages caused by negligence or lost IFS/Forfar equipment.
- I will attend trips, lectures, labs, and activities to the best of my ability and understand that voluntary negligence may result in not receiving certifications.
- I will keep my cabin and living area clean and orderly at all times.
- I will be respectful to all fellow groups and students, staff, and locals at all times. The use of obscene language is discouraged and I am aware that use of obscene language is fully prohibited in and around the lodge building.
- I will not recklessly endanger my health and safety or the health and safety of those around me.
- I will follow all local laws. I will not commit acts of violence or threaten to commit any acts of violence. I will not tamper with or misuse fire alarms, fire fighting equipment or safety equipment.
- Harassment, intimidation and bullying is not tolerated.
- I will not take part in or facilitate harassment, intimidation, bullying or discrimination or use discriminatory language of any kind, including, but not limited to, discrimination based on gender, gender identity, race, national origin, ethnicity, age, religion, sexual orientation, disability, handicap or intelligence.
- I will follow all rules listed in this Code of Conduct and understand that any violation of policies and laws may result in trip termination at my own expense.
4.0 STUDENT agrees to be solely responsible for his or her own health, safety and agrees to hold IFS harmless regarding same.
5.0 STUDENT agrees to provide IFS with completed, signed and notarized Medical Consent and Release and Assumption of Risk Form and Medical History Form and all other forms associated with registration prior to the Forfar Marine Science Program.
6.0 STUDENT agrees to the following:
A. $500.00 non-refundable, deposit due immediately to reserve your seat in the program
B. $6, 499 program fee is due two (2) months before the program start date.
C. Program fees are nonrefundable.
D. STUDENT is responsible for all charges associated with travel to Nassau, health/travel/dive insurance, dive masks, snorkel, fins, wet suit, and ACA membership fees.
E. All payments are to be made by checks, money orders, or wire transfers payable to International Field Studies, Inc. Credit card charges will be subject to a 3.5% processing fee.
F. In the event of an act or occurrence that is beyond the control of IFS, you will be refunded for your trip, minus any cost incurred by IFS. These events include, but are not limited to:
(i) act of God (such as, but not limited to, fires, explosions, hurricanes, and floods); Ii) war, hostilities (whether war be declared or not), invasion;
(iii) rebellion, revolution, insurrection, or military or usurped power, or civil war; (iv) acts or threats of terrorism
Neither IFS nor STUDENT shall be considered in breach of this Contract to the extent that performance of their respective obligations (including payment obligations) is prevented by an event as described above.
7.0 STUDENT, for his or her heirs, successors, assigns, agents and affiliates, including insurers, officers, representatives, successors and assigns of such entities, does hereby forever release, discharge, acquit, indemnify and hold harmless IFS from any and all liability, claims, demands, damages, expenses, actions and causes of actions either at law or in equity and any and all other loss and damage of every kind and nature which STUDENT may now have or which may hereafter accrue in any manner directly or indirectly resulting from performance hereunder.
8.0 MODIFICATION: This Agreement shall not be modified or amended, except by written instruments of subsequent date duly executed by the parties hereto.
9.0 ASSIGNMENT: This Agreement may not be assigned or delegated in whole or in part by STUDENT without the express written consent of IFS shall remain in force and effect.
10.0 MERGER: This agreement supersedes any prior understandings, or agreements, oral or written, with respect to the matters set forth herein.
11.0 WAIVER: The waiver of a breach of any term or condition of this agreement shall not be deemed to constitute the waiver of any other breach of the same or of any other term or condition.
12.0 CHOICE OF LAW: This Agreement shall be governed and construed in accordance with the laws of the State of Ohio and any suit brought to enforce its provisions shall be brought in the County of Franklin, State of Ohio.
13.0 EXECUTION: This Agreement shall bind both parties when signed and dated by both parties and any document signed by only one party shall be deemed and offer open to be accepted in a reasonable time unless same offer specifies different means or time for acceptance.
THE UNDERSIGNED warrant and acknowledge that each has read and understood this Agreement and that each has the power and authority to execute this Agreement.
