    Teacher Trainee Insurance Disclaimer

    I have heard, read and understood that training with or being certified by the Circus Arts Institute (CAI) does not provide me insurance liability coverage from the CAI, Carrie Heller, the ACE Circus Safety Program or AYCO.

    I understand that prior to teaching/spotting/training students on aerial equipment, I must be covered by a liability insurance policy through my employer, studio or obtained for myself.

    I have read and understand the below recommendations given by the Circus Arts Institute as to appropriate coverage for spotters/teachers/trainers/studio owners.

    I understand that these recommendations are not professional advice and all aerial spotters/teachers/trainers should seek professional advice from an insurance professional as to appropriate coverage.


    Insurance recommendations to the Teacher Trainees:
    This information is designed to convince you of the need of proper insurance coverage in the case of a student's injury. This is not professional advice. We first suggest that all spotters/teachers/trainers/studio owners talk to an insurance professional before taking on students.

    • If you are hired to teach by a person/company, make sure employer has included you on their liability insurance policy before beginning spotting/teaching/training.
    • If you are purchasing your own policy, be sure to do that before working with students.
    • Ensure that your equipment is covered in your insurance policy.
    • Ensure that your ‘student’ as well as yourself are covered in your insurance policy.

    Teacher Trainee Non Compete

     

    Carrie Heller, M.S.W, RPT (“Owner”) of Circus Arts Institute, LLC DBA Carrie Heller’s Circus Arts and {name144[1]} {name144[2]} (“Spotter, Teacher Trainee, potential Teacher in Training” and/or “Independent Contractor” AKA “Contractor”) agree to the following:

    During the term of Contractor’s engagement with Owner and while the Circus Arts Institute and/or Carrie Heller’s Circus Arts is in operation, Contractor will not either directly or indirectly on her/his behalf or on the behalf of others, solicit or divert business to herself or any competing business any client of her/his or of Owner or her contractors.

    This contract states that you may not:

    1. Compete with the Purchaser and the Business;
    2. Solicit employees of the Purchaser and the Business;
    3. Solicit customers of the Purchaser and the Business; and
    4. Divulge certain proprietary information of the Purchaser and the Business.

    All Circus Arts Institute training materials are copyright protected.  As such, trainees may not share or reproduce our training materials. All of our training materials are to be used ONLY in conjunction with our in-house training as we provide many pieces of important information that are not necessarily included in the training material. To receive the training material, instructors must attend a Circus Arts Institute Aerial Teacher Training course in person.

    • You will not use Circus Arts Institute Aerial Teacher Training materials to teach or train another person and/or instructor at any other studio or facility.

    In consideration of being allowed to participate online or in-person classes and trainings (collectively the “Activities”) provided by Circus Arts Institute (the “Host”), the Participant, does hereby agree to the fullest extent permitted by law, as follows:

    1. TO WAIVE ALL CLAIMS that they have or may have against the Host arising out of the Participant’s participation in the Activities or the use of any equipment provided by the Participant or Host including but not limited to permanent residential and commercial rigging systems and temporary aerial rigging structures (“Equipment”).
    2. TO ASSUME ALL RISKS of participating in the Activities and using the Equipment, even those caused by the negligent acts, conduct or spoken, written or implied information by the Host, its owners, affiliates, operators, employees, agents, and/or officers. The Participant and his/her parent(s) or legal guardian(s) understand that there are inherent risks of participating in the Activities and using the Equipment, which may be both foreseen and unforeseen and include serious physical injury and death. These inherent risks include, but are not limited to, operator, rigging installation, and equipment failures.
    3. TO RELEASE the Host, its owners, affiliates, operators, employees, agents, and officers from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of his/her participation in the Activities and use of the Equipment. The Participant and his/her parent(s) or legal guardian(s) specifically understand that they are releasing any and all claims that arise or may arise from any negligent acts or conduct of the Host, its owners, affiliates, operators, employees, agents, and/or officers, to the fullest extent permitted by law. However, nothing in this Agreement shall be construed as a release for conduct that is found to constitute gross negligence or intentional conduct; and
    4. TO INDEMNIFY the Host, its owners, affiliates, operators, employees, agents, and/or officers, from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of participation in Activities and/or use of the Equipment.

    Personal Responsibility

    The Participant understands that Participant’s participation in the Activities is voluntary and further understand that while the Host may give advice and guidance to Participant about Rigging and Equipment it is for reference only. Participant assumes all liability for risks involved in Participation of Activity.

    The Participant understands that Participant is obligated to follow the rules of the Activities and that he/she can minimize his/her risk of injury by doing so and through the exercise of common sense and by being aware of his/her surroundings.

    If, while participating in the Activities, the Participant observes any unusual hazard or condition, which they believe jeopardizes Participant’s personal safety or that of others, Participant will remove Participant from participation in the Activities and immediately bring said hazard or condition to the attention of the Host.

    To the extent that any portion of this Agreement is deemed to be invalid under the law of the applicable jurisdiction, the remaining portions of the Agreement shall remain binding and available for use by the Host and its counsel in any proceeding.

    I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

    In consideration of being provided the services of the Circus Arts Institute, LLC, DBA Carrie Heller's Circus Arts, their agents, owners, officers, volunteers, participants, employees, independent contractors, volunteers, interns, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "CAI" and/or “Releasees”), I hereby release, indemnify, and discharge CAI from any and all claims including a claim arising from contracting COVID-19 corona virus.

    I acknowledge that participation in circus arts training and instruction, including aerial arts, trapeze, gymnastics and other various disciplines, entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to self, to property, or to third parties.  I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

    The risks include, among other things: slips and falls; falling from equipment; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life threatening hazards; strains, cuts, bruises, muscle soreness and fractures; musculoskeletal injuries including head, neck, and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity.  Traveling to and from shows, meets and exhibitions raises the possibility of any manner of transportation accidents. In any event, if your child is injured, your child may require medical assistance, at your own expense.

    CAI employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions.  They may give incomplete warnings or instructions, and the equipment being used might malfunction.

    1. I expressly agree and promise to accept and assume all of the risks existing in this activity.  My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
    2. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless CAI from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity, including any such claims which allege negligent acts or omissions of CAI.
    3. Should CAI or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
    4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
    5. In the event that I file a lawsuit against CAI, I agree to do so solely in the state of Georgia, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.
    6. To the extent that my participation in a CAI program is limited to virtual classes, virtual therapy, virtual training or the training by my following directions contained in an instructional video, I agree that the releases contained herein shall be applicable.
    7. I am aware that training during and after the COVID-19 pandemic involves certain inherent risks, dangers, and hazards, which can result in serious infection, personal injury or death.  I further acknowledge, understand, appreciate and agree that my participation may result in possible exposure to and illness from COVID-19.  While protocols and personal discipline may reduce this risk, the risk of serious injury, illness and even death is not possible to fully mitigate.
    8. I hereby freely agree to assume and accept all known and unknown risks of exposure to COVID-19, even arising from the negligence of the Releasees or others and assume full responsibility for my participation.
    9. I agree that if any portion of this Agreement is held to be invalid, that portion shall be severable and the remaining Agreement shall continue to have full force and effect.
    10. In the event of my death or incapacity, this Agreement shall be effective and binding upon my heirs, estate, next of kin, executors, administrators, assigns and representatives.

    I have read this Agreement and I fully understand its terms. I understand that I am giving up substantial rights, including my right to sue CAI and its staff for injuries resulting from the inherent risks of training during and after the COVID-19 pandemic and the ordinary negligence of the facility and staff. I further acknowledge that I am signing this Agreement freely and voluntarily, without inducement or assurance of any nature, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by the laws of the state of Georgia.

    RIG COMPLIANCE AGREEMENT

    • We are a part of the American Circus Educators (ACE) Safety Network and follow the Guidelines for the Circus Arts Safety Network. Included in this document are the minimum rigging standards to use in our trainings. We ask that you read through this document. These minimum standards do not guarantee safety. By participating in the active rig physical part of the training, you are representing that you meet these minimum standards. If you meet the standards, you may participate; if not, we ask that you participate without a rig by developing your teacher’s eye, taking notes, listening intently, and asking questions
    • The location of my rig, or the private studio I am using, have both an emergency plan/procedure in place as well as first aid supplies in case of emergency.
    • I agree to always have another person in the room while in the air in case of emergency.
    • My rig has been inspected to ensure it’s present condition is in compliance to use for the training.
    • I represent that my rig is in compliance to use for this training.

     

    Note to trainee: After registration, you will receive an automated email. In the email there is a lot of information about your registration, including directions for a ZOOM "Rig Visit".
