Agreement for All Payments to Tampa Bay Body Sculpting
Non-Refundable Payment Policy
At Tampa Bay Body Sculpting, all payments made for our services and products are non-refundable. By proceeding with any payment, you acknowledge and agree to the following terms, which are designed to protect both the client and the business from any misunderstandings or disputes:
1. No Refunds
- All payments made, including deposits, consultation fees, and surgery costs, are non-refundable. This applies regardless of the payment method used (credit card, debit card, cash, etc.).
- Once a payment is made, you cannot request a refund under any circumstances, including but not limited to a change of mind, failure to comply with pre-operative instructions, or inability to attend appointments.
2. Commitment to Service
- By making a payment, you are committing to the service or procedure outlined in your agreement.
- The payment guarantees the allocation of time, resources, and medical staff necessary to perform your procedure. These resources are committed immediately upon processing your payment, which makes all payments final and non-refundable.
3. Payment Schedule
- $500.00 non-refundable deposit: Required to secure your procedure’s pricing and scheduled date.
- 50% of the total surgery cost: Must be paid 4 weeks prior to the scheduled surgery date.
- 100% of the total surgery cost: Must be paid 2 weeks prior to the surgery date.
- If the remaining balance is not received by the stated deadlines, Tampa Bay Body Sculpting reserves the right to cancel your procedure, and all payments made up to that point, including the deposit, will be forfeited.
4. Cancellations and Rescheduling
- Cancellations by Client: If you choose to cancel your procedure at any time, you will not receive a refund for any payments made up to the date of cancellation.
- Rescheduling by Client: To reschedule your procedure, you must notify us at least 14 days in advance. A $500 rescheduling fee will be assessed for changing your surgery date.
- Cancellations by Tampa Bay Body Sculpting: If we need to reschedule your procedure due to unforeseen circumstances, your payments will be applied to the new date. No additional fees will be charged in such cases.
- Failure to provide proper notice or not showing up for your scheduled surgery will result in forfeiture of all funds paid.
5. Labs and Medical Clearance
- All required labs must be completed and reviewed by Dr. Miles 2 weeks prior to surgery.
- If medical clearance is necessary, it must also be obtained and submitted 2 weeks prior to your procedure.
- Obtaining the necessary labs and medical clearance is the responsibility of the patient. Failure to provide this documentation will result in a $500 rescheduling fee, which will be added to your surgery balance.
6. BMI and Weight Requirements
- Patients will be weighed on the day of surgery. Your weight must align with the BMI agreed upon during your consultation.
- If your BMI exceeds the agreed-upon limits, parts of the surgery may not be performed, and additional surgeries will be required with additional fees.
- A new surgery quote will be provided if your weight is outside the discussed parameters.
7. Chargebacks and Disputes
- Tampa Bay Body Sculpting has a zero-tolerance policy for chargebacks and payment disputes.
- By making any payment, you waive your right to initiate a chargeback or dispute on any grounds, including dissatisfaction with services, failure to follow pre-operative or post-operative instructions, or inability to attend scheduled appointments.
- If a chargeback is initiated, Tampa Bay Body Sculpting will dispute the claim to the fullest extent and may pursue legal action. We reserve the right to charge additional fees to cover administrative, legal, and collection costs associated with resolving the chargeback.
- We encourage you to contact our office immediately to resolve any concerns regarding payments, scheduling, or services.
8. Medical Necessity for Procedure Cancellation
- If surgery cannot be performed or is postponed for medical reasons at the discretion of Dr. Miles or the medical staff, your surgery may be rescheduled once you obtain medical clearance from your Primary Care Physician.
- Additional fees may apply for use of the surgical facility, medical staff, or anesthesia services if this occurs. No refunds will be issued in these cases.
9. Arrival Policy
- If you fail to attend your scheduled surgery without prior notification, all funds paid to date will be forfeited.
- If surgery is delayed or canceled on the day of surgery due to medical concerns identified by Dr. Miles, your procedure will be rescheduled pending medical clearance, and additional fees may apply.
10. Final Acknowledgment
- By proceeding with any payment, you confirm that you have read, understood, and agreed to the terms outlined in this Non-Refundable Payment Policy.
- You acknowledge that Tampa Bay Body Sculpting will begin committing resources to your procedure upon receipt of the deposit, making all payments non-refundable.
- This agreement is legally binding, and an electronic signature is considered as valid and enforceable as a physical signature.
Electronic Signature
By signing or electronically accepting this document, you agree that the terms and conditions outlined constitute a legally binding contract. An electronic signature holds the same validity as a handwritten signature for this agreement.
