Drug Free Workplace Act & Consent to Test

1. The unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in Life Changes, Inc.
2. There is an ongoing drug-free awareness program in place to inform employees about: The dangers of drug abuse in the workplace.
   1. Life Changes, Inc.’s policy of maintaining a drug-free workplace, specifically, employees of Life Changes, Inc., must not report for work impaired using alcohol or another drug, except when medical allowances must be made.
   2. The prohibition against drug use/possession/trafficking in the workplace.
   3. Any available referrals for drug counseling, rehabilitation, and employee assistance programs; the penalties that may be imposed upon employees for drug abuse violations occurring in the workplace.
3. Reasonable accommodations to any disabled employee requiring medical treatment.
4. It is required that each employee provide a signed verification of the statement required by paragraph (a), such verification will be placed in personnel file.
5. As a condition of employment, any employee must notify the employer in writing of any criminal drug statute conviction for a violation occurring in the workplace no later than five calendar days after such conviction.
6. Life Changes, Inc. will notify any certification agency or addictions treatment funder and any other federal funding source in writing within ten (10) calendar days after receiving notice under subparagraph (d) from an employee or otherwise receiving actual notice of such conviction.
7. One or more of the following actions will be taken within 30 calendar days of receiving notice under subparagraph (e) with respect to any employee who is so convicted:
   1. Taking appropriate personnel action against such employees, up to and including termination.
   2. Requiring such employees to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health, law enforcement, or other appropriate agency. [Public Law 100-690 Title V, Subtitle D, 41 USC 701 et seq.]
8. Upon arrival, all Life Changes, Inc. clients will be assessed for physical limitations, and/or disabilities. Clients will be accommodated, according to individual needs, to the area of the facility that provides A.D.A. accommodation, as applicable.

As a prospective employee, employee or volunteer, of Life Changes, Inc. ("the Company"), I understand that the use of drugs, alcohol and other controlled substances in the workplace creates a safety concern for all employees. In the interest of creating a safe working environment, I hereby give my consent for the Company to conduct the drug and alcohol tests it considers necessary as outlined in the Drug Test policy and I understand that these tests are a condition for employment.

I authorize the Company to take the necessary specimens from me to test for drugs, alcohol and other controlled substances, and I authorize laboratory or medical personnel retained by the Company for these tests to release the results to Life Changes, Inc.  I further understand that if the tests are positive, and for this reason I am not hired, or am terminated, I will be given the opportunity to explain the results of this test. I release the laboratory or medical personnel conducting the drug test, the Company, and the Company´s employees, directors, officers and successors from any liabilities, claims and causes of action, known or unknown, contingent or fixed, that may result from these tests and I agree not to file any lawsuits or other actions to assert a claim.
