READ AND ACKNOWLEDGE BEFORE COMPLETING COMPLAINT FORM
If you believe that you have been the target of discrimination, it is critical that you comply with all legal deadlines and notice requirements related to your claim.
For instance, to preserve an employment discrimination claim under Kansas state law, you must file with the Kansas Human Rights Commission (KHRC) within 180 days of the date you believe you were discriminated against. To preserve your claim under federal law, you must file with the Equal Employment Opportunity Commission (EEOC) within 300 days of the date you believe you were discriminated against.
For some civil rights violations, you may be required to file a notice or pursue options with a government agency before you can file a lawsuit in court. All these claims are governed by strict legal requirements related to time deadlines and notice requirements. Failure to abide by them could prevent you from pursuing your claim in court.
Contacting the NAACP Kansas State Conference or any branch does not eliminate your duty to file the necessary notice(s), nor does it toll the statute of limitations. You are still required to meet the statutory deadlines.
The NAACP Kansas State Conference requires all complainants to complete and sign a complaint form. Once submitted, the complaint form will then be processed by the Branch closest in geographic proximity to where the alleged discrimination occurred.
To file a complaint with the NAACP Kansas State Conference, (1) the alleged discriminatory act(s) must have occurred in Kansas, and (2) the matter cannot be already pending in any court of law.
Due to the sheer volume of complaints received, the NAACP Kansas State Conference cannot pursue every matter. Our ability to assist is directly related to our available resources. Therefore, we cannot accept criminal case complaints at this time.
If your need is immediate and urgent, contact a private attorney, a local public defender, or the state’s bar association.
Please note that we will not process your application unless all questions are completed, along with a one-party summary of the alleged discrimination that occurred. Incomplete applications can not be investigated. You may add additional pages or documents supplementing your claim using the upload feature.
