Pursuant to Minnesota law including, but not limited to, Minn. Stat. § 604.055 I AGREE THAT: in consideration of Anishinaabe Endaad LLC allowing my participation in cultural activities, including attending sweat lodge ceremony which includes sitting in a heated space within 4 feet of hot rocks for up to 120 minutes, harvesting wild rice which includes but is not limited to being in a canoe over shallow waters but dangerous bottom, outdoors, physical labor, lifting heavy objects, being subjected to insects and heat. (“Activities”) I, {name} the participant, for myself and on behalf of my heirs, administrators, personal representatives or assigns, do agree to hold harmless, release and discharge Anishinaabe Endaad LLC, its owners, agents, independent contractors, employees, officers, directors, representatives, assigns, members, affiliated organizations, insurers, and others acting on its behalf (hereinafter collectively referred to as “PARTIES”), of and from all claims, demands, causes of action and legal liability, whether the same be known or unknown, anticipated or unanticipated, due to and/or its PARTIES’ negligence and, to the fullest extent permitted by law, gross negligent or intentional acts or omissions.
I do further agree that I shall not bring any claims, demands, legal actions and causes of action, against Anishinaabe Endaad LLC as stated above in this clause, for any economic and non-economic losses due to bodily injury, death, property damage sustained by me, operations and Activities offered by Anishinaabe Endaad LLC. I agree that any claims that arise from this release of liability should be brought in White Earth Band of Ojibwe Tribal court.
I further agree to defend and indemnify Anishinaabe Endaad LLC from and against any and all such claims. I acknowledge having been advised that the Activities described above include certain risks of bodily injury and death that cannot be entirely avoided or mitigated.
Finally, I swear that I am at least 18 years of age and understand the risks associated with my participation in activities and have considered this waiver and understand its binding nature. Further, I swear that I was under no obligation or pressure to sign this waiver and was allowed ample opportunity to consider and ask questions, including a chance to not participate in the activity.
