  • TERMS OF SERVICE AGREEMENT - 

    Consulting Agreement Between "The Patient Advocate Group Inc." and "Client" is purchasing a prepaid block of consulting hours as described in the package Client selects below.

    NATURE OF SERVICES. Although our consultants may be experienced nurses, doctors, accountants, or attorneys, they are not operating in that capacity. They act solely as consultants sharing their personal anecdotes and experiences dealing with the healthcare industry.

    We are not telling you what to do, and we are not providing medical, nursing, accounting, legal, or investigative advice or services, and no professional-client relationship is created.

    We help explain how healthcare facilities, insurance companies, and medical providers function, and how, in most instances, they will listen to you and take you seriously because of the regulatory repercussions possible if they carelessly fail to provide proper care or reimbursement.

    We help Clients understand actions they may choose to take, such as contacting malpractice attorneys, the press, or the medical board when appropriate. All decisions remain solely yours. No outcome is guaranteed.

    HOW WE WORK. The most effective and direct route of communication is typically by phone. In extenuating circumstances, and for additional fees to cover travel time, travel expenses, and parking costs, we can provide in-person services and accompany patients when visiting a healthcare provider. In-person services must be arranged in advance and are billed separately from the prepaid consultation packages below. 

    Work begins promptly upon payment; the fee compensates same day availability, research, record review, scheduling, and consultation time. ALL SALES ARE FINAL. NO REFUNDS.

    Client Understand and Accepts the terms and conditions of this TERMS OF SERVICE AGREEMENT and agrees to authorization and payment with credit card as provided.

     

    WHAT I AM BUYING. I understand and agree that I am purchasing the advocate's TIME, IMMEDIATE AVAILABILITY, and BEST EFFORTS - not any particular result. Immediate availability, including nights, weekends, and holidays, has independent value by itself, and that value is earned by The Patient Advocate Group Inc. the moment work begins on my behalf.

     BEST EFFORTS - NO GUARANTEED OUTCOME. Outcomes depend on third parties we do not control, including hospitals, physicians, insurance companies, and regulatory agencies. The Patient Advocate Group Inc. promises diligent, good-faith best efforts within the hours purchased, and nothing more. I agree that a disappointing or unsuccessful outcome does not mean services were not rendered or were not as advertised.

    MEASURE OF PERFORMANCE. I agree that the SOLE AND EXCLUSIVE measure of whether services were rendered is the time expended or made available on my behalf, as documented in the advocate's contemporaneous time and activity log. I agree to accept that log as conclusive evidence of performance absent clear error. Consultation time includes calls with me and my family, calls and correspondence with providers, insurers,facilities, and agencies, research, record review, waiting on hold, scheduling, and drafting - whether or not I am present for it.

     ENTIRE AGREEMENT. This agreement is the complete understanding between us. I am not relying on any promise, estimate, or statement - spoken, written, or on any website or advertisement - that is not contained in this agreement.

    PAYMENT. Work begins promptly upon payment; the fee compensates immediate availability, research, record review, scheduling, and consultation time from the moment of engagement.

    ALL SALES ARE FINAL. NO REFUNDS, in whole or in part, including for unused hours or dissatisfaction with outcomes. Before raising any billing concern with my bank or card issuer, I agree to first contact The Patient Advocate Group Inc. at (908) 451-5748 and allow ten business days to resolve it.

    In the event I dispute credit card charges, causing Patient Advocate Group to hire an attorney to collect payment(s) previously authorized, I agree to be personally responsible for payment of fees and for all attorney fees and interest on uncollected fees or fees reimbursed by credit card disputes. 

    By signing below I acknowledge that I have read and agree to these terms, that I am the authorized user of the payment method used, and that I knowingly waive any right to a refund or to dispute this charge with my card issuer for time expended or made available under this agreement.
